Many products are large, freight-classified, or manufacturer-built wellness equipment and may require specialized delivery and installation planning.

5. Pricing and Payment

6. Risk of Loss and Title Transfer

Title and risk of loss transfer upon delivery of the product to the shipping carrier.
Once a product has been released to the carrier:
• The shipment is considered in transit
• Freight liability is governed by carrier liability and/or manufacturer transit protection policies
• Proper inspection and documentation procedures must be followed at delivery
• Customers are responsible for complying with inspection requirements outlined in the Shipping Policy and applicable Brand-Specific Terms
• Signing the delivery receipt without noting visible damage may limit eligibility for freight damage claims and may be considered confirmation that the shipment was received in acceptable condition, subject to applicable carrier and manufacturer policies.

7. Freight and Delivery Responsibilities

Many products are shipped via third-party freight carriers.

Customers agree to:

Ensure adequate property access for delivery
Arrange unloading assistance if required
Inspect shipments at time of delivery
Document visible damage on the Bill of Lading (BOL)

Failure to comply with inspection and delivery procedures may limit claim eligibility.

Additional charges may apply for:

Delivery refusal (except where refusal is due to documented transit damage)
Address changes after shipment release
Storage fees
Specialized unloading or transport requirements
Missed delivery appointments

Elemental Restore does not provide installation services unless explicitly agreed in writing. Customers are responsible for proper installation, site preparation, and compliance with local codes unless otherwise stated.

8. Returns and Manufacturer Authorization

Freight-classified products are considered special-order shipments.

Return eligibility:

Varies by brand
May be subject to manufacturer authorization
May include restocking, freight, refusal, and administrative fees
May be non-returnable depending on brand policy

Returns are governed by the Return & Refund Policy and Brand-Specific Terms.

9. Residential and Commercial Use

Unless explicitly stated otherwise, products sold through elementalrestore.com are intended for residential use.

Commercial installations may be permitted where the manufacturer allows commercial use. Warranty and service coverage for commercial use remains subject to manufacturer terms.

Commercial, institutional, or high-volume use may:

Void manufacturer warranties
Limit return eligibility
Affect service or parts coverage

Elemental Restore does not provide medical advice.

HSA/FSA eligibility is determined by the customer’s plan administrator.

We do not guarantee reimbursement.

Customers are responsible for reading and following all product manuals, warnings, electrical requirements, temperature guidelines, and safety instructions provided by the manufacturer.

Use of any product contrary to manufacturer guidance, including improper installation, misuse, or operation beyond recommended settings, may result in injury or property damage and may void manufacturer warranty coverage or limit available remedies.

11. Limitation of Liability

To the fullest extent permitted by law, Elemental Restore shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits or loss of use
Installation or removal costs
Third-party service costs

Our total liability shall not exceed the purchase price of the product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Elemental Restore from claims arising out of:

Misuse of products
Improper installation
Commercial use where restricted
Failure to follow safety or assembly instructions

13. Chargeback Cooperation

Before initiating a credit card dispute or chargeback, you agree to contact Elemental Restore to attempt resolution.

We reserve the right to provide supporting documentation to financial institutions in the event of a payment dispute, including delivery receipts, carrier tracking, and policy acknowledgments.

14. Dispute Resolution and Arbitration

Governing Law:
These Terms shall be governed by the laws of the State of Georgia.

Binding Arbitration:
Any dispute relating to purchases, delivery, returns, or warranty claims shall be resolved exclusively through binding arbitration conducted in Georgia, administered by a recognized arbitration provider under its rules.

Class Action Waiver:
Disputes must be resolved on an individual basis. You waive the right to participate in class actions or class arbitrations. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.

15. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

16. Non-Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Elemental Restore.

We may update these Terms at any time. Updates take effect upon posting. Continued use of the Website constitutes acceptance.

18. Entire Agreement

These Terms, together with the Shipping Policy and Return & Refund Policy, constitute the entire agreement.
